Vermont Commission on International Trade and State Sovereignty Letter to USTR

Dear Ambassador Kirk:

We are contacting you on behalf of the Vermont Commission on International Trade and State Sovereignty (Commission) regarding negotiations of the Working Party on Domestic Regulation. The Commission understands that the U.S. Trade Representative (U.S.T.R) is currently reviewing a draft text of disciplines for domestic regulation under the Global Agreement on Trade in Services (GATS). The Commission is concerned that language proposed in the draft disciplines for domestic regulation could substantially affect how states adopt and implement law. Specifically, we are concerned with the proposal that state laws be pre-established, objective and transparent, and relevant to the services provided. The Commission requests that U.S.T.R. clarify these disciplines in order to protect the rights of states to enact and implement law according to their traditional, regulatory authority...
